Non Custodial Fathers Marched in Islamabad On Father's Day!




The issue of Non-Custodial parents in Pakistan has been ignored for long. 


These are parents who have been separated and the children live with one of them and the other parent (which is the father in 95% of the cases) is not allowed to either meet his children or only allowed a meeting inside court premises (for children less than 7 years of age).

The meetings in court have a bad psychological effect on the children as well as their fathers. The time given is too little (once in a month or maximum twice for one-two hours). Also this schedule is not followed and quite often the custodial parent doesn't bring the child for meeting with the father.





Thus children are completely alienated from their fathers. And they are usually brainwashed against them.


These fathers are now demanding their right to meet their children peacefully inside their houses instead of courts. 





They did a press conference inside National Press Club Islamabad, highlighting their suffering and how distressful the never-ending court proceedings are for them yet they are not able to get easy access to their children. 





The issue of psychological impact on children when they have to meet their fathers in courts was also highlighted by psychologists in the press meet.


From a religious point of view it was highlighted how wrong it was for one of the parents to not allow the other parent to meet his/her child.


The Non-Custodial fathers said that there was an obvious bias towards them during the court proceedings and no strict action was taken against those using delay-tactics and those not complying with court orders (of getting the child to meet his father).

The press conference was followed by a march till China Chowk Islamabad in which Non-Custodial fathers held banners highlighting their plight and suffering. 







Some fathers broke down into tears while describing how they were not allowed to see their children, with one of the fathers exclaiming that he was only allowed to see his daughter twice in court room since 9 years!














One of the fathers exclaimed how the system didn't care if the schedule of meeting was not followed and how distressful it was to see his child in the court room

As a result of this march, the Lahore High Court has taken up for hearing a five year old petition pertaining to home visitation of children of Non-Custodial parents. The first hearing took place on the 23rd of June. Non Custofial fathers from Lahore also presented themselves in court on the hearing day.



The organisers of this walk are very hopeful for a positive outcome from the Lahore High Court Petition and have announced another walk for their rights in Lahore after Eid on the 23rd of July in Aiwan-e-Adal!

NON-CUSTODIAL FATHERS' RIGHTS WALK 19TH JUNE (FATHER'S DAY)




AIM:


Striving for rights of Non Custodial Fathers in granting them the following rights:


1. Ensuring easy and early "access" of child to the Non-Custodial Parent (within a 15 day period, before the case is settled)


2. Settlement of guardianship / custody cases within a 6 month time frame (as also binding by the law)


3. Granting of Home Access / Home Visitation to Non-Custodial fathers for children of all ages (including the age of weaning).


4. Granting of home stay for 2 days per week alongwith the schedule of meeting rights granted in Supreme Court Decision (2018 SCMR 1991) for all children of school going age.


5. Strict implementation and introduction of punishments for any parent not abiding by the  visitation schedule.

پاکستان کی تاریخ میں پہلی مرتبہ باپ اپنے اور اپنے بچوں کے لیے نکل رہے ہیں


پاکستان کی تاریخ میں پہلی مرتبہ نان کسٹوڈیل باپ اپنے اور اپنے بچوں لیے نکل رہے ہیں






پاکستان جیسا ملک جہاں مسائل کی بھرمار یے۔ وہاں ایک اہم

  مسئلہ نان کسٹوڈیل والدین کا مسئلہ ہے۔ جس پر کوئی بات نہیں کرنا چاہتا۔ 



 پاکستان میں اگر میاں بیوی میں علیحدگی ہو جائے تو بچے

عموما" ماں کو دیے جاتے ہیں۔ اور عدالتیں بھی عموما" باپ کو نابالغ بچوں سے گھر کی ملاقات تک نہیں دیتیں۔



 اگر میاں بیوی دونوں نیک، سمجھدار اور خدا ترس ہوں تو کبھی بھی ایک دوسرے سے بچوں کو الگ نہ کریں۔ علیحدگی کے بعد آپس میں ہی بچوں کے ملنے ملانے کے معاملات طے کر لیں۔


لیکن عمومی طو پر ایسا ہوتا نہیں۔ اور خاص کر شہری زندگی میں زیادہ تر بچے ماں کے پاس رہتے ہیں۔


ہمارے ہاں یہ تقریبا" رواج بن گیا ہے کہ اگر خاتون کے پاس بچے ہوں تو وہ اور اس کے گھر والے بچوں کو ان کے سگے باپ سے زبردستی دور رکھنے کو درست فعل سمجھتے ہیں۔ بلکہ وہ اس عمل کو اپنی بیٹی کی زندگی میں آنی والی 'پرابلمز' کا بدلہ تصور کرتے ہیں۔





اکثر ایسے خاندانوں سے جب سوال کیا گیا کہ کیا وہ سگے باپ سے بچے زبردستی دور رکھنے کو گناہ سمجھتے ہیں یا نہیں تو انہوں نے جواب میں یہ بات کہی: "اس باپ نے جس کے ساتھ زیادتی کی وہ بھی کسی کی بیٹی تھی



اب یہ بات غور طلب ہے کہ میاں بیوی کی آپسی لڑائی میں قصوروار جو بھی رہا ہو کیا اس سے ماں باپ کا اپنا رتبہ کم ہو جاتا ہے؟


کیا ماں باپ کے حقوق اور بچوں کے فرائض ختم ہو جاتے ہیں؟


کیا خلع لینے والی ماں کے پیروں تلے جنت نہیں رہتی؟ اور کیا ایسا باپ جنت کا دروازہ نہیں رہتا؟


کیا ہمارا مزہب یہ اجازت دیتا ہے کہ کوئی شخص اپنا بدلہ   نکالنے کے لیے ماں یا باپ سے بچوں کو چھین لے؟اور ان پر ظلم کرے؟


قران مجید کی سورہ لقمان (آیت نمر  15-14) میں کہا گیا ہے کہ والدین مشرک بھی ہوں تب بھی ان سے حسن سلوک کیا جائے


اس معاملے پر ہمارے مفتیان کرام کی رائے بھی موجود ہے۔


مفتی اکمل صاحب' باپ سے اس کے بچوں کو زبردستی دور رکھنے اور اس سے بد زن کرنے کے عمل کے بارے میں فرماتے ہیں


" یہ حرام اور گناہ کبیرہ ہے۔ کسی نے اس کو حلال سمجھ کر کیا تو اسلام سے بھی خارج ہو جائے گا"


مفتی طارق مسعود نے بھی اس معاملے پر اکثر بات کی ہے۔

والد سے بچوں کو دور رکھنے کے بارے میں فرماتے ہیں


"یہ سب ظلم ہے جس پر ان خواتین کو قیامت کے روز  اللہ کے سامنےجواب دینا پڑے گا"


اب عدالتوں کا رویہ تو اس معاملے بہت ہی ظالمانہ ہے۔ باپ کی کوئی سنوائی ہی نہیں۔ نابالغ بچوں کو دیکھنے کے لیے باپ کتنا ہی تڑپ رہا ہو۔ عدالت اس سے فوری ملاقات کروانے کا حکم کبھی صادر نہیں کرتی




سالوں کے کیس کے بعد جب اجازت ملتی ہے تو باپ کو عدالت کے احاطے میں قیدیوں کی طرح بچوں سے ملنے دیا جاتا ہے۔ وہ بھی مہینے میں ایک مرتبہ یا زیادہ سے زیادہ دو مرتبہ، ایک یا دو گھنٹے کے لیے۔






ان ملاقاتوں میں اکثر بچہ ملاقات کے لیے لایا ہی نہیں جاتا۔ باپ تڑپتا ہی رہ جاتا ہے۔ اس پر بھی عدالت کوئی خاطر خواہ ایکشن نہیں لیتی۔



ان عدالتی ملاقاتوں سے بچوں کے ذہنوں پر بھی منفی اثرات مرتب ہوتے ہیں۔ انہیں اپنا سگا باپ ایک اجنبی شخص معلوم ہوتا ہے اور اکثر بچے اپنے ہی باپ سے نفرت کرتے ہیں۔ حقارت سے دیکھتے ہیں۔  بچوں کو باپ سے بد زن کر دیا جاتا ہے اور ہمارا نظام خاموش تماشائی بنا یہ ظلم دیکھتا رہتا ہے۔۔



اس ظلم کے خلاف آواز اٹھانے کے لیے اس "فادرز ڈے" پر اسلام آباد میں ایک آگاہی واک ہو رہی ہے۔ اور پورے پاکستان سے باپ اس میں شرکت کے لیے آ رہے ہیں۔ 







واک کے لیے آنے والے ایک متاثرہ والد نسیم تنولی کا کہنا ہے کہ وہ 9 سال میں صرف ایک بار اپنی بیٹی سے عدالت میں مل پائیں ہیں اور وہ ایران تفتان بارڈر سے صرف اپنی بیٹی کے لیے اسلام آباد آرہے ہیں







ہماری دعا ہے کہ جب بچے ہو جائیں تو کوئی ماں باپ بھی علیحدہ نہ ہوں اور اگر ایسا کرنا ہی پڑے تو بچوں کے ذریعے اپنا بدلہ نہ نکالیں۔ ایسا کرکے وہ ایک دوسرے سے زیادہ اپنے بچوں پر ظلم کرتے ہیں

Kulbhushan Yadav (Jadhav) a RAW Agent - Indian Media PROVES!









Indian "keyboard warriors" are usually seen arguing that the terrorist spy of Raw (Kulbhushan Jadav) was innocent and that there is "insufficient evidence" against him.

Surprisingly India's own media has done reports on him, which *prove* beyond doubt that Jadav was indeed a Raw Agent living with a Fake Passport and a Fake name!



Let's analyse a few reports:

- Reported (from TOP Indian Intelligence Officials) that Jadav was indeed a spy who broke his COVER when he communicated with his family in Marathi:

"Kul Bhushan Jadhav was arrested by Pakistan's Intelligence Bureau as he had dropped his guard and started talking like a Marathi Manoos during his telephone conversations with his family, disclose senior officers from central intelligence..."

AND

"Top intelligence officers have revealed that after 14 years of working in the region he had become a bit complacent. It is suspected that his phone was on surveillance by the Pakistani agencies and those who were monitoring his communications "

    2. Jadav's own friends and family ADMITTED he was a spy as per the Indian News papers!


    The "Indian Express" made this startling revelation that Jadav had told some of his own friends he was going to work for RAW!

    The news paper wrote ( http://indianexpress.com/article/ind...istan-4608185/) :

    "To some friends in Mumbai, who spoke to this newspaper, Jadhav claimed he was setting up an independent business in Iran. To others, he claimed he was beginning work with RAW. "

    What stronger evidence does one need than this? Jadav had even told some of his own friends he was going to work for RAW !

    "The Ahmedabad Mirror," reported that his friends and family were even aware that he had been under surveillance by Pakistani authorities:

    " Jadhav, who last visited Mumbai some four months back, was under watch by the Pakistani agencies during his movements in Iranian cities in the course of his work, his close friends from Mumbai police told this newspaper .."

    And " The family had lost contact with Jadhav since February leading to the suspicion that he was in the custody of Pakistan for a while now. As a result, two other local contacts who were supposed to provide back-up assistance to Jadhav are also reportedly missing for over a month" (source:

    3. Jadav's colleagues in the Indian Navy too thought he was involved in 'espionage':


    " His batchmates remember him as an elusive person, who never attended reunions and remained absent for long periods. To one, he dropped broad hints of being involved in government-linked activity.

    4.  Jadav's Fake Passport:

     

      

     Many common Indians and Indian anchors are seen arguing that since Jadav had an "Indian" passport therefore he could not have been a spy since India would not supposedly send a spy to Iran/ Balochistan with an Indian passport.


    Firstly, as we have already seen that both Jadav's friends and family and top Indian Intelligence officials have already admitted that he indeed was a spy. Now let us move on to what the Indian media itself reported regarding his passport...

    " According to reports, Jadhav has allegedly obtained a fake passport in the name of Hussein Mubarak Patel from Pune in November 2003.
    Reports suggest that Jadhav was working in Iran under this fake name. "

    So the Indian Media has already admitted that he not only got a passport with a fake name but also that he was working in Iran with a fake name!

    Lets move on to what the "Indian Express" wrote regarding his passport:

    "What is CLEAR is that in November 2003, Jadhav  then still an Indian Navy engineer, on the verge of retiring after 14 years of service  illegally obtained passport E6934766 in Pune, identifying him by the pseudonym Patel"

    So according to the Indian express it is CLEAR that Jadav had indeed an illegal Indian passport and that too with a Fake name, while he was still a serving officer!

    So long story cut short; this Indian spy was trying to hide behind a Muslim name in Iran and Iran is more 'safer / easier to work' for Indian Muslims than for Pakistani one's.

    Jadav was handling most of his operations at the Iran-Pakistan border (at Chahbar) and travelled to Balochistan and Karachi undetected when he had to meet other terrorists. 




      5. Why was Jadav's family kept out of the scene for a long time? 

       

       


      As reported by a part of the Indian Media, Jadav's family, initially did not reply to any of the questions being asked to them.

      If Jadav was truly innocent why was his family not allowed to talk to the media? Its being suspected that they wanted the Indian Intelligence Officials to own him (just like families of other Indian spies spoke up when India disowned its own spies previously):

      " The (Jadav's) family remained tight-lipped on Saturday though several media persons made attempts to get in touch with them. However, a local milk delivery boy, when shown a picture of Kulbhushan, immediately identified it and claimed he had seen him "in his flat just days before Holi".

      6. Mr. Shirish Thorat, former Indian Police Officer and currently a New-York based security expert, accepted that it was part of the plan to disown Jadav (as an Indian spy) and also to pressurise the family to do the same!  

      The Indian paper quoted him as follows:


      "In Jadhav's case too, the agencies have launched an expeditious exercise to retrace his footsteps and shut down all of his possible ongoing operations. The first step is to disown Jadhav as their operative and also ask the family to disassociate with him." - (source:

      So another Indian security expert, clearly stated that RAW was trying to clear all evidences linking up to Jadav !

      7. India's ex-Raw chief (Amarjit Singh) and Mr. Bannergee ( Former secretary RAW ) statements on an Indian media channel:



      Both of them said that Jadav could have been our (India's) spy. They also said that policy is to deny it publicly when the spy is caught.


      The question arises:  

      When do former spies say such things??

      Imagine if India's "Top Spy Master" wanted to deny Jadav's espionage, he would have clearly said that 'Jadav couldn't be a spy at all'. 


      But Mr. Amarjit wanted to 'play safe'. He wanted to tell his young soldiers that look I am not disowning him yet not clearly accepting that he was a spy (as that would be against India's national interests)

      Muhammad (PBUH)

                                                    
      Thousands of years ago Moses (P) told the children of Israel, the promise of God Almighty; about raising a prophet who would be 'like Moses' (P); ‘I (God) will raise them up a prophet from among their brothers (the brothers of the children of Israel), like you (Moses); and I will put my words in his mouth, and he shall speak to them all that I shall command him. It shall happen that whoever will not listen to my words which he shall speak in my name, I will require it of him. (The Bible Deuteronomy 18:18-19). However, in the law of Moses (the Torah) it was written: ‘So Moses the servant of the LORD died there in the land of Moab but no man knows of his tomb to this day here has not arisen a prophet since in Israel like Moses, (Deuteronomy 34:5,6,10). Thus long after the death of prophet Moses (P) ‘the prophet like Moses’ had not yet appeared. 

      Hundreds of years later, the Jews sent priests and Levites from Jerusalem to ask John the Baptist (Prophet Yahya, P) some questions: ‘Who are you?’ they said. He replied: ‘I am not the Christ.’ They asked him, ‘What then? Are you Elijah?’ He said, ‘I am not.’ ‘Are you That Prophet?’ He answered, ‘No.’ They asked him, ‘Why then do you baptize, if you are not the Christ, nor Elijah, nor That Prophet?’ (The Bible John1:19-21, 25). Thus the Jews were still waiting for three distinct personalities the Christ (i.e. the Messiah, Jesus P), Elijah (P), and THAT prophet. The Prophet like Moses, the prophet whom God had promised to raise had still not come! 

      Jesus (P) told his followers 'I have yet many things to say unto you, but ye cannot bear them now. However when he, The Spirit of Truth, is come, he will guide you into all truth (John 16:12-13). And about 600 years after Jesus (P), in the desert of Arabia in Makkah, among the Ishmaelites (the Arabs, the brothers of the children of Israel) was born The Prophet, the prophet Muhammad (P). A prophet sent as a mercy to all mankind, a prophet who always spoke in the name of God and spoke what He commanded him to.   

      The Makkans had always believed what Muhammad (P) had to say for his truthfulness was well known in Makkah. When Muhammad (P) started preaching the message of Islam, the message of worshipping one God alone without any partners, the Makkans were annoyed by this message; for the Idols and religious ceremonies were a great source of income for the Makkan leaders (many of them Muhammad’s own uncles). The influential and rich among them threatened him. But the Prophet replied ‘Even if you keep the sun on my right hand and the moon on my left, I will not give up preaching my message.’  

      They made Muhammad (P) ‘a great offer!’ 
       Muhammad (P) would be made 'the chief or the king,' get the keys of the Ka'ba, be given lots of money or married in the most honourable tribe if he wished. Makkah would be under his command if he gave up his work. But the Prophet declined all these offers!

      All power and authority was declined for God and for the love of His people, by Muhammad (P). The people for which he grieved and ardently wanted that they knew and accepted the truth. This shows Muhammad’s (P) commitment to his mission and his love for humanity in general. God had to tell him again and again not to grieve for the disbelieving folk: ‘You (O Muhammad) wouldst only, perchance torment yourself to death, following after them, in grief if they believe not in this Message (Quran18:6)’ - Grieving even to death for the people’s good! Such was Muhammad’s (P) greatness, which brings tears to the eyes of the believers.

      The Muslims were oppressed and persecuted by the Arab disbelievers and so was the prophet. In Makkah insulting and hurting the prophet was an everyday event, ‘the nobles’ amongst the Quraish used to tell their slaves to do so. Once a lot of unbelievers gathered around him and started abusing and shouting loudly, this resulted in such jostling that the prophet had to take refuge at some place. Abu Lahab used to get animal refuse and filth put at the prophet’s door and his wife used to get thorns put in the way of the prophet. Dust and garbage was commonly thrown upon the prophet’s blessed head. The Makkans had decided that no Makkan would ever go or listen to the prophet. A person named Aqba listened to some of his words. Aqba’s friend rebuked him and asked him as to why he did not spit on the prophet’s face while he (Muhammad P) was talking. Aqba then spat on the Prophet’s (P) face. The prophet had to offer his prayers in secret in Makkah because the Makkans used to put animal intestines over him and also while food was being cooked at his house (source: Ibn Hisham Vol.2 p.280, 28, 233,277,238,276-277).

      Once some unbelievers put a cloth around his neck and pulled it causing him (P) to suffocate and fall on the ground. The Prophet went to Taif to preach his message and there the people stoned him so much so that his shoes were filled with blood. He prayed forgiveness for them as 'they knew not.'

      Muhammad and his followers were forced to live for 3 years in a valley. Suffering with hunger, eating the leaves of the trees, getting some food secretly they passed those years of hard-ship. Then the unbelievers decided that one man from every Arab tribe would go and kill Muhammad (P) but the prophet was saved by God’s help. All this was patiently endured by the merciful apostle of God and he never lost his trust in God, who had already told him “Verily the Later portion (of life) shall be better for thee than the First. Thy Lord shall give thee, and thou shall be satisfied. (Quran 93:4-5).” And how could one forget: “They were afflicted by misery and hardship and were so convulsed, that the Messenger and those who believed with him said, 'When comes God's help?' Ah, but surely God's help is nigh. (Quran 2:214). God's help came and Madina offered him to be their leader. 

      The Muslims had to fight many wars with the Arab unbelievers who had oppressed them. The large amounts of money that came through warfare was given in charity by the prophet. A man who had denied authority before denied the usage of money and as the prophet’s wife said: ‘We used to see three crescents in two months, and no fire used to be made in the houses of Allah's Apostle. Urwah said, ‘What used to sustain you?’ Aisha said, ‘dates and water, except that Allah's Apostle had neighbors they used to give the Prophet some milk, and he used to give us from it to drink’ (Muslim no. 5282). Umar (Rta) cried seeing this state of the prophet and said 'O Allah's Apostle! …though you are Allah's Apostle you are living in destitute’. The Prophet replied. 'Won't you be satisfied that they enjoy this world and we the Hereafter?’ (Bukhari 60:435).  

      Whenever someone wronged Muhammad (P) he always forgave him. He only punished people when they violated the state laws or when they harmed other people. As his wife said: He (the prophet) never took revenge for himself concerning any matter that was presented to him (Bukhari 81:777).

      Many people tried to kill him and he was even able to get the sword of a man who came to kill him but he still forgave him (source: Bukhari 59:458), he forgave the unbeliever who had pushed his daughter and she had had a miscarriage, how many of us can do the same? Just 3-4 years before his death a Jewish woman brought poisoned sheep for the prophet to eat. His (P) palate showed ill effects. The companions wanted to kill the woman but the prophet forbade them (source: Bukhari 47:786)

      A certain prisoner of war was a vigorous orator and used to speak openly against the prophet, some companions proposed that his teeth be broken but the prophet said 'If I get his teeth broken God shall break My teeth, even though I am a Prophet! (Ibn Hisham as quoted in Maududi's Tafhim-ul-Quran Vol.5 p.14). And when he (P) finally conquered Makkah, all those who had killed or oppressed the Muslims and the prophet, thought they would be put to death. The prophet said, ‘This is the day of mercy’ ‘You are safe, you are free.’ Peace be upon the merciful apostle of Allah.

      Muhammad (P) brought a great revolution in the whole world and turned the Arab Bedouins, who were an ignorant and savage nation, into the most civilized nation humanity ever new. Muhammad emphasized on acquiring knowledge and thinking deeply about God’s creation. He abolished poverty, maintained justice and he was the first prophet to completely abolish the concept of slavery, gradually. 

      Slaves were acquired during wars, thus (after a certain time)  the Muslims were forbidden enslaving anyone in wars and were left with only 2 choices i.e. they would let all the captives go free with or without some ransom. They had no other choice, God said: ‘tie fast the bonds (make captives) then set them free, either by grace or ransom, till the war lays down its loads (Quran47:4). Finally it was also revealed ‘Those of your slaves who seek freedom, contract with them accordingly (Quran 24:33). The prophet said: ‘And one should not say, my slave, or my slave-girl, but one should say my lad, my lass' (Bukhari 46: 728).  

      In his ‘last sermon,’ emphasizing on human equality, he said ‘All mankind is from Adam and Eve, Arabs and non-Arabs, whites or blacks have no superiority over one another except by piety or good action’ Abolishing the concept of revenge-killings, he said Verily your blood, your properties are sacred and inviolable. Annulled are the blood-revenges of the Days of Ignorance (Muslim no. 2803). He said 'Whoso slays any human being unless it be a person guilty of man-slaughter or of spreading disorders in the land, shall be as if he had slain mankind altogether; And whoso gives life to a soul, shall be as if he has given life to mankind altogether (Quran 5:32). 

      When the prophet and his companions fought those who had oppressed them, he forbade everyone to harm any innocent person: ‘God does not forbid you from being just and kind to those who do not fight you. God forbids you to making friends, Only those who fight you for (your) Faith, and drive you out of your homes’ (Quran 60:8-9) And The way (to fight or punish) is Only open against those who do wrong to the people, and are insolent in the earth wrongfully. But he who BEARS patiently and is forgiving surely that is true constancy'(Quran 42:42-43).  

      Muhammad (P) taught and displayed through his character doing good even to enemies! He taught that we make enemies our friends, rather our Intimate friends: ‘Goodness and Evil can never be equal. Repel Evil with what is better or good. Then will he between whom and you was enmity become as he were your intimate friend (Quran 41:34)’

      Muhammad (P) being such a great man was yet so humble, different from the ‘mighty men’ of today who’s anger and rudeness, is their pride. Lives of great men are not easy; Muhammad (P) suffered so much, yet never complained to God. No male child of the prophet ever survived and Ibrahim his son whom he loved with all his heart left him at the age of 15* months. ‘My eyes weep, my heart is in grief but from my tongue I shall say words which God likes,’ were the words of the prophet. Based on his teachings the Muslims were able to make great educational, religious and social contributions to the world in the past (which led to the Renaissance and Reformation in the west as well). Following the prophet can make us change the world, discover new things and make our status in the world better.
